Federal Judge Throws Out Electoral College Lawsuit
We are now just a matter of days away from Congress certifying the Electoral College results; but there are still lawsuits being filed in an attempt to overturn the outcome of the November Presidential Election. The latest bid to make that happen came to an end on Friday making the headlines in the process.
The lawsuit in question was filed by Rep. Louis Gohmert of Texas, as well, as several Arizona Republicans. Their goal was; to have a judge rule that Vice President Mike Pence be given the power to overturn the election results. It is somewhat telling that Pence came out last week and called for the suit to be dismissed; which we will get into more in a moment.
Judge Jeremy Kernodle of the Eastern District of Texas dismissed the lawsuit on Friday; stating that the plaintiffs did not have the standing to sue. Undaunted, Gohmert said that the lawsuit would now be heading to the Fifth Circuit of the U.S. Court of Appeals.
The basic argument in the suit is that widespread voter fraud.
Particularly in certain states, resulted in a win for President-elect Joe Biden. To this point; there has been no evidence presented by plaintiffs in the countless suits that have been filed and dismissed, a list that continues to grow on a seemingly daily basis.
It is worth noting that Judge Kernodle was nominated by Trump and confirmed by the Senate back in 2018. He had to decide whether the lawsuit from Gohmert and the Arizona Republicans had any merit; but he failed to do so. In his dismissal of the suit; he said that it “alleges at most an institutional injury to the House of Representatives. Under well-settled Supreme Court authority, that is insufficient to support standing.”
The decision comes on the heels of a plea from Vice President Mike Pence on Thursday; that the lawsuit be rejected. Pence made political news by suggesting that the lawsuit should be aimed at the House or Senate; as opposed to the Vice President. He did not say whether or not he would consider the idea of interfering in the Electoral College count; although the belief is that he will not.
